Judge rejects Live Nation’s bid to dismiss antitrust case

Live Nation-Ticketmaster suffered a legal setback on Friday when a federal judge denied the company’s attempt to dismiss a key part of the U.S. Department of Justice’s (DOJ) antitrust lawsuit. The ruling, issued by U.S. District Judge Arun Subramanian, allows the case to move forward, posing a major challenge for the concert industry giant. The DOJ, along with attorneys general from 29 states and Washington, D.C., accuses Live Nation of using its dominance in the live entertainment sector to pressure artists into using its concert promotion services to gain access to its major venues. The lawsuit claims this creates an illegal “tying” arrangement, restricting competition. Judge Subramanian rejected Live Nation’s argument that independent concert promoters, not artists, book venues, ruling that the DOJ’s complaint sufficiently outlines how artists may be effectively forced to use Live Nation’s promotional services due to its monopoly on large amphitheaters. Additionally, the judge ruled that the coalition of states had sufficiently demonstrated their standing, arguing that Live Nation-Ticketmaster’s alleged monopolistic practices have led to inflated ticket prices for consumers. This ruling strengthens the case against the company as it faces increasing scrutiny over its business practices.
